This document constitutes the Privacy Notice for the purposes of the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals (the “LFPDP”) and the provisions that emanate from it or are related to it and is intended to inform the owners of the scope and general conditions of the processing of their personal data, so that they are able to make informed decisions about the treatment of the same.
I. IDENTITY AND ADDRESS OF THE PERSON IN CHARGE
Teknei, Sociedad Anónima de Capital Variable (the “Controller”), domiciled at 101 Masaryk St., office 1401, interior 43, Col. Polanco, Del. Miguel Hidalgo, C.P. 11560, Mexico City, Mexico, is responsible for collecting personal data and sensitive personal data of the Data Subject, for the handling of such data and for its protection.
II. PERSONAL DATA TO BE PROCESSED
To carry out the proper provision of the services of the Responsible, we will collect personal data of the Data Controller through personal delivery, directly or through the transfer of the same, prior consent given by the Data Controller to the Responsible or its Agents, likewise, the Responsible may collect personal data indirectly through publicly available sources and other sources available in the market, likewise, we collect your personal data through the website www.teknei.com.
The personal data we collect for the provision of services are identification data, such as: (i) Name, (ii) Email, and (iii) Company, where applicable.
III. PURPOSE OF PROCESSING
Primary Purposes
The personal data provided to the Responsible will be used to contact you, once you have shown your interest in any of our services by visiting our website, and mainly by filling out our contact form, and in that sense to offer you the attention you deserve.
Secondary Purposes.
The personal data you provide to the Controller may be used to carry out secondary purposes for statistical or advertising purposes, i.e., the Controller may use your data to determine the number of requests handled through its website, or send you information regarding the provision of our services or our newsletter.
If you do not agree that your personal data be used for the secondary purposes described above, you may refuse by sending an email to oficialdedatos@teknei.com only stating that you do not consent to the Responsible for using your personal data for secondary purposes, indicating in your request the data that allow us to identify you within our records or databases.
IV. MECHANISMS FOR THE EXERCISE OF A.R.C.O. RIGHTS
The Responsible has implemented a mechanism for the holder to know what information we have about the holder, what we use it for, and the conditions of use (Access), and the conditions of use given to them (Access), likewise, the holder may request the correction of the information held by the Controller whenever it is outdated, inaccurate or incomplete (Rectification), to be removed from our records or databases when it is considered that it is not being used in accordance with the principles, duties and obligations under the regulations (Cancellation), as well as to oppose the use of their personal data for specific purposes (Opposition).
In that sense, you may at any time exercise the above rights over the personal data held by the Responsible, by sending a written request via email to oficialdedatos@teknei.com accompanied by the following information:
- Name of the owner, as well as an address, telephone number or other means of contact to respond to the request.
- Official documents proving the personality of the owner of the data.
- A clear description of the changes you wish to make to your personal data, or, if possible, any other document that makes it easier to locate the personal data.
Once your request has been received, the Responsible Party will have a period of no more than 15 (fifteen) calendar days to respond to said request and send you a report on the same through the means of contact provided.
V. MECHANISMS AND PROCEDURES FOR THE REVOCATION OF CONSENT
The Responsible makes available the personal data office located at Masaryk 101, office 1401, interior 43, Colonia Polanco, Alcaldía Miguel Hidalgo, C.P. 11560, Mexico City, Mexico, in which the holder by filling out the corresponding forms may revoke consent for the use of their personal data held by the Responsible, likewise the holder may revoke consent by email to the following address oficialdedatos@teknei.com in which you must explain in detail your request for revocation, and the Responsible will send you a report on it within a period not exceeding 3 calendar days through the email in which the request was made.
VI. USE OF COOKIES AND WEB BEACONS
The Responsible uses “cookies” and other technologies through which it is possible to monitor your behavior as an Internet user, in order to provide you with a better service and user experience when browsing our website www.teknei.com.
The data we obtain from these tracking technologies are the following: (i) Browsing hours, (ii) Time spent browsing our website, (iii) Sections viewed, and (iv) Internet pages accessed prior to visiting our website.
VII. CHANGES TO THE PRIVACY NOTICE
In the event that the Responsible Party must make changes or updates to this privacy notice in order to comply with new legislation, jurisprudence or internal policies, it will notify it on the website www.teknei.com by implementing a banner, so it is suggested to the owner of the data to periodically enter the website.

This Privacy Policy (hereinafter, the “PRIVACY POLICY”) regulates, in general, the collection and processing by GRUPO TEKNEI IT, S.L.U. (hereinafter, “TEKNEI”) of (i) the personal data that you provide to us as a user of the website accessible through the domain name www.teknei.com (hereinafter, the “WEBSITE”), including the services available at any given time through the WEBSITE; and (ii) other data collected through other collection systems duly identified below. All of the above without prejudice to the specific provisions established in certain sections, forms or services available on the WEBSITE in order to provide you with the relevant information and, if applicable, to obtain your consent.
TEKNEI reserves the right to modify the PRIVACY POLICY to adapt it to new legislative, jurisprudential and/or administrative developments, as well as to the practices developed at any time through the WEBSITE, taking into account your rights and interests at all times.
In any case TEKNEI will provide you with the appropriate technical resources so that you can access the PRIVACY POLICY in order to duly comply with the information obligations that we must observe in accordance with the applicable regulations on data protection.
1. Who is the Data Controller of your data?
GRUPO TEKNEI IT, S.L.U., a company with registered office in Bilbao (Bizkaia), Gran Vía de Don Diego López de Haro, nº 17, registered in the Mercantile Register of Bizkaia in volume 5.990, folio 183, page BI-76.724 and with C.I.F. B04966446, is responsible for the processing of your data.
TEKNEI has appointed a Data Protection Officer (DPO), in charge of the management and control of privacy in TEKNEI, who can be contacted through the e-mail address rgpd@teknei.com.
2. How did we obtain your data?
The data that we process in TEKNEI have been obtained from you through (i) the different forms that you fill in while browsing through the WEBSITE and/or through other channels (e.g. registration as a user of the WEBSITE -when applicable-, contact forms, forms related to job offers and/or selection processes, etc.); (ii) by sending an e-mail inquiry; or (iii) through other duly identified collection systems.
In the event that the personal data provided belong to a third party, you warrant that you have informed such third party of the PRIVACY POLICY and have obtained their authorization to provide their data to TEKNEI for the purposes stated below.
Additionally, we inform you of the possible processing of your social network data through the corporate profiles that TEKNEI maintains available in each social network in which it is present, all under the terms and conditions established in each social network.
3. What kind of data do we process?
The data that we process in TEKNEI are those that you have provided us during your navigation through the WEBSITE, through the appropriate forms that we use to formalize our contact with you and/or through e-mail, as well as those others that, if applicable, we obtain through TEKNEI’s corporate profiles in the social networks in which we are present.
In particular, TEKNEI processes the following categories of data:
- Identification and contact data (name, surname, ID card number, postal and e-mail address, telephone number, etc.).
- Professional data (company in which you perform your functions, position and functions, professional postal and e-mail address, and professional telephone number) to the extent that (i) you provide them through the corresponding forms; and (ii) they are necessary for your business location and/or for the maintenance of our business relationship with you or your entity.
- Codes and identification keys as a registered user of the WEBSITE and/or of the applications accessible through it.
- Internet browsing data (e.g. IP address, web page visits, wifi network connections, etc.).
- Data on personal characteristics, training, employment, etc. (in the case of job applications/offers and/or TEKNEI selection processes in which you participate on a voluntary basis).
4. For what purpose do we process your data and under what legitimacy?
The processing of your personal data pursues the following purposes:
- Manage and process your registration as a user of the WEBSITE, when possible, and on the basis of your request for pre-contractual measures or the contractual relationship established with you in this regard.
- To manage your access to and use of the contents and services that TEKNEI makes available to you through the WEBSITE, including blog services, social networks or any other functionalities that may be accessible from the WEBSITE at any time and based on your request for pre-contractual measures or on the contractual relationship established with you in this regard.
- To process and manage the contracting of products or services that you may formalize with TEKNEI through the WEBSITE, to manage the shipment of such products and, in general, to maintain, manage and control the contractual relationship that you establish with us as purchaser of our products or services, all based on your request for pre-contractual measures or the contractual relationship established with you in this regard.
- Process and manage the request for information, suggestions, complaints or claims made through the WEBSITE or e-mail, and on the basis of your request for pre-contractual measures or the contractual relationship established with you.
- To send you by various means, including electronic means, commercial and advertising communications from TEKNEI and other companies of the business group in which TEKNEI is integrated, regarding products, services, offers, promotions and any other relevant information concerning such entities, provided that you have consented and on the basis of such consent.
- To manage your application for employment or your registration in a job offer of the companies that are part of the Business Group in which TEKNEI is integrated and your participation in the corresponding selection process, all on the basis of your request for pre-contractual measures.
We remind you that, in cases where the processing is based on your consent, you may revoke it at any time, freely and free of charge, under the terms indicated in Section 7 below.
5. To whom do we disclose your information?
Apart from those cases in which TEKNEI is obliged to do so by law (e.g. Tax Administrations, Justice Administration or other Public Administrations), your data will not be communicated to third parties, unless you have explicitly consented to it.
There are no plans for international transfers of your data.
6. How long will we keep your data?
In general, personal data will be kept (i) as long as they are necessary for the purpose for which they were collected; and (ii) as long as you do not revoke your consent to the processing, when this was the basis of lawfulness, or request their deletion at an earlier time; as well as (iii) the additional time necessary to comply with the legal obligations that TEKNEI must observe.
In any case, we inform you that TEKNEI has established internal data purification policies aimed at controlling the retention periods of personal data in its possession, so that they may be canceled when they are no longer necessary and / or appropriate for the purpose for which they were collected.
In particular, it is noted that, for the management of job applications, your data will be kept for a maximum period of 2 years.
7. What are your rights?
The applicable data protection legislation grants you a number of rights relating to your personal data that you may exercise during the processing of your personal data. These rights are indicated below:
- Access to your data: you have the right to access your data to know what personal data concerning you we are processing.
- Request rectification or deletion of your data: in certain circumstances, you have the right to rectify inaccurate personal data concerning you that are processed by us or even to request their deletion when, among other reasons, the data are no longer necessary for the purposes for which they were collected.
- Request the limitation of the processing of your data: in certain circumstances, you have the right to ask us to limit the processing of your data, in which case we inform you that we will only keep them for the exercise or defense of claims as provided for in the applicable regulations on data protection.
- To portability of your data: in certain circumstances, you have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format, and to transmit it to another data controller.
- Oppose the processing of your data: in certain circumstances and for reasons related to your particular situation, you have the right to oppose the processing of your data in which case, we would stop processing them unless, for compelling legitimate reasons, or the exercise or defense of possible claims, they must be kept.
Likewise, you have the right to withdraw your consent, when this is the basis for the legitimacy of the processing, at any time, without affecting the lawfulness of the processing based on the consent prior to its withdrawal.
You may exercise these rights by sending a written request to TEKNEI at the postal address indicated in Section 1 or by sending an e-mail to the address rgpd@teknei.com.
Finally, please note that you can file a complaint with the competent Supervisory Authority (in Spain, the Spanish Data Protection Agency), especially when you have not obtained satisfaction in the exercise of your rights. You can contact this Authority through its website: www.aepd.es.
8. Security measures
TEKNEI will treat your data at all times with absolute confidentiality and keeping the mandatory duty of secrecy with respect to them, in accordance with the provisions of the applicable regulations on data protection, adopting for this purpose the necessary technical and organizational measures to ensure the security of your data and avoid its alteration, loss, treatment or unauthorized access, given the state of technology, the nature of the data stored and the risks to which they are exposed.
